SMS Messaging
Introduction
PSS, a program of BIAW, uses SMS and MMS text messaging to support communication with parents, participants, clients, and authorized representatives. Messages are used for informational, service-related, scheduling, billing, and account-related purposes only and are not used for marketing or promotional activities.
SMS/MMS Consent and Terms
By providing your mobile telephone number to PSS, a program of BIAW, you consent to receive periodic SMS or MMS messages from us. These messages may include service coordination, appointment reminders, billing or account status notifications, document requests, and other important communications related to your relationship with PSS, a program of BIAW.
Providing Your Telephone Number and Notification Obligations
You affirm that the mobile phone number you provide is accurate and current and that you are the authorized subscriber or owner of the telephone number. You agree to notify PSS, a program of BIAW, promptly of any changes to your contact information, including changes to your telephone number, by contacting us at info@biaw.org prior to the change taking effect.
Consent to Receive Automated Communications
By voluntarily providing your telephone number(s), you expressly consent to receive recurring automated and non-automated text messages from PSS, a program of BIAW related to services, scheduling, billing, account updates, and general communication. Consent to receive text messages is not a condition of receiving services. Message and data rates may apply.
Opt-Out Instructions
You may opt out of receiving SMS or MMS messages at any time by replying STOP to any message you receive. You may also opt out by contacting us at info@biaw.org. After opting out, you will receive one final message confirming your request, and no further messages will be sent unless you opt back in.

Carrier Participation
Participating carriers in the United States may include AT&T, T-Mobile®, Verizon Wireless, Sprint, Boost, U.S. Cellular®, MetroPCS®, InterOp, Cellcom, C Spire Wireless, Cricket, Virgin Mobile, and others. Not all carriers support SMS or MMS services. T-Mobile is not liable for delayed or undelivered messages.
Data Collection and Use
In connection with SMS services, PSS, a program of BIAW, may collect your mobile telephone number, wireless carrier information, and the date, time, and content of messages exchanged. This information is used solely to provide requested services, maintain records, and facilitate communication related to services or account matters.
Service Modifications and Termination
PSS, a program of BIAW, reserves the right to modify, suspend, or discontinue SMS or MMS messaging services at any time, with or without notice.
Indemnification
You agree to indemnify and hold harmless PSS, a program of BIAW, and BIAW from any claims, including claims related to privacy or the Telephone Consumer Protection Act (TCPA), arising from your provision of a telephone number not owned by you, failure to notify us of changes to your contact information, or related violations. This includes reasonable attorneys’ fees and costs.
Participation Requirements
By participating in SMS messaging, you affirm that you are at least eighteen (18) years of age, possess a wireless device capable of two-way messaging, are a customer of a participating wireless carrier, and have an active text messaging plan. Message delivery, availability, and compatibility may vary by carrier and device.
Miscellaneous
You represent that you have the authority to agree to these terms and that doing so does not violate any other agreement. If any provision of these terms is found unenforceable, the remaining provisions will remain in full force and effect.
